Celui-ci comporte plusieurs clauses encadr\u00e9es par des r\u00e8gles de droits communs. Le prestataire de services est ainsi tenu d&rsquo;une obligation contractuelle de conseils et il doit ex\u00e9cuter le travail promis et l&rsquo;ensemble des prestations convenues dans le contrat, notamment lorsque son client n&rsquo;est pas un professionnel de l&rsquo;informatique. Il arrive cependant parfois que certaines clauses, certaines obligations ne soient pas totalement respect\u00e9es lors de l&rsquo;ex\u00e9cution d&rsquo;un contrat informatique. Ce non respect peut parfois entra\u00eener le prestataire responsable \u00e0 commettre erreurs et des fautes dans l&rsquo;ex\u00e9cution de ses missions.\u00a0<\/p><p>En cas d&rsquo;ex\u00e9cution d\u00e9fectueuse d&rsquo;un contrat de maintenance informatique, le contrat \u00e9tabli doit contenir des modalit\u00e9s de rupture qui visent \u00e0 pr\u00e9voir les conditions dans lesquelles le prestataire pourra \u00eatre condamn\u00e9 \u00e0 r\u00e9parer les pr\u00e9judices subis par le client. Dans le cas de la mise en accord des deux parties sur une transaction amiable mettant fin au contrat, la responsabilit\u00e9 ou non du prestataire ne peut \u00eatre engag\u00e9e sans preuve suffisante comme le rappelle une jurisprudence datant du 6 Juillet 2021.\u00a0<\/p><p>En pr\u00e9ambule \u00e0 une d\u00e9cision d\u00e9finitive, le tribunal rappelle trois conditions imp\u00e9ratives \u00e0 r\u00e9unir afin de constituer un pr\u00e9judice : qu&rsquo;il soit d\u00e9montr\u00e9 un dommage subi par la soci\u00e9t\u00e9 demanderesse ; qu&rsquo;il soit d\u00e9montr\u00e9 une faute, commise par la d\u00e9fenderesse et qu&rsquo;il soit d\u00e9montr\u00e9 un lien direct et certain de causalit\u00e9 entre la faute et le dommage.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<\/div>","protected":false},"excerpt":{"rendered":"<p>Une transaction amiable ne peut prouver les fautes d&rsquo;un prestataire informatique.
